Terms of use

These terms of use (the “Agreement”) are an agreement between you and the publisher of the BolDeCuisine mobile app and of boldecuisine.com (the “Service”). By creating an account, signing in, or using the Service, you accept this Agreement. If you do not accept it, do not use the Service.

The same Agreement covers the Kitchilly app, published by the same person from the same software: what is said below about BolDeCuisine applies to either one.

What the Service offers

BolDeCuisine is a members-only community app: recipes, videos, newsletters, events, a group discussion forum, and messaging with your advisor. You get in by invitation or with a community's code.

We grant you a personal, non-exclusive, non-transferable and revocable right to use the app for strictly personal, non-commercial purposes. You may not resell it, rent it, decompile it, scrape its content, or circumvent its access controls.

Who may use the Service

The Service is not intended for anyone under 16. By creating an account you confirm that you are at least 16 years old and able to enter into this Agreement.

Your account

• Give accurate information, and a name your community can recognise you by.
• You are responsible for keeping your credentials confidential and for everything done from your account.
• An account is personal: it is not shared and not transferred.
• You can delete your account at any time from the app (see Delete my account).

Rules of conduct — zero tolerance

We tolerate no objectionable content and no abusive behaviour, with no exception and no prior warning. In particular, you may not post, send or share:

• hateful or discriminatory words or images, or anything inciting violence, including on the basis of origin, religion, sex, sexual orientation, disability or age;
• harassment, threats, intimidation, doxxing, or any other persecution of a member;
• pornographic or sexually explicit content, or content involving minors in any way;
• violent, shocking or graphic content, or content glorifying crime, terrorism, self-harm or suicide;
• content that is unlawful, defamatory, deceptive, or that infringes anyone's rights (copyright, trademark, privacy, likeness);
• spam, unsolicited advertising, chain messages, scams or phishing attempts;
• malware, or any attempt to gain unauthorised access to the Service, its data, or another member's account;
• impersonation of anyone, including another member or a community administrator.

You also agree not to use the Service to harvest other members' personal data, or for unauthorised commercial purposes.

Reporting, blocking and moderation

Every message, comment, photo and member profile can be reported from inside the app, and any member can block another: a blocked member's content immediately stops being shown to you.

We commit to reviewing every report and acting on it within 24 hours. Depending on severity, that means removing the content, warning its author, suspending their access, or permanently deleting their account, with no refund and no notice.

We may also remove content or suspend an account on our own initiative when we find a breach of this Agreement. Moderation is carried out by the publisher and by each community's administrators.

To report abuse from outside the app, write to cedric@boldecuisine.com — that is the published point of contact for any complaint about content.

The content you post

You keep ownership of what you post. You grant us a free, worldwide, non-exclusive licence to reproduce, display and distribute that content for the sole purpose of operating the Service — that is, showing it to the other members of your community. The licence ends when you delete the content or your account, subject to technical backups and legal retention obligations.

You warrant that you hold the rights you need in what you post, and you are solely responsible for that content.

Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately and without notice if you breach this Agreement — in particular the rules of conduct above — or if the law requires it.

Availability and warranties

The Service is provided “as is” and “as available”. We do not warrant uninterrupted availability, freedom from errors, or the accuracy of content posted by members. Recipes and advice shared in the app are informational: always check your appliance's safety instructions and the allergens in the ingredients you use.

BolDeCuisine is an independent community of users. Thermomix®, Cookidoo® and Vorwerk® are registered trademarks of Vorwerk, which does not publish this Service and is not affiliated with it.

Liability

To the extent permitted by law, we are not liable for indirect damages, loss of data or loss of profit arising from your use of the Service. Nothing in this Agreement removes the rights the law gives you as a consumer.

Personal data

How we handle your data is described in our privacy policy, which forms part of this Agreement.

Changes

We may change this Agreement. If a change is significant, the new version will be shown to you in the app and you will be asked to accept it before continuing to post content. The date of the last update is at the top of this page.

Governing law

This Agreement is governed by French law. Failing an amicable resolution, the French courts have jurisdiction, without prejudice to the consumer-protection rules that may apply to you.
